3. Collection and processing of personal data

3.1. General

Your personal data will only be processed by us if either the storage of the data is necessary for technical reasons (legitimate interest) or if you voluntarily provide us with this data for specific purposes (data communication). We use the following personal data for data communication (if this data is made available to us): first name, last name, address, date of birth, gender, telephone number, e-mail address, payment data, order data. The personal data you provide will only be used to the extent necessary to fulfill the respective purpose and/or required or permitted by law.

3.2. use of the data

Below you will find an overview of what happens to your personal data when you visit our website, as well as the most important aspects of data processing on our website.

3.2.1. Visiting our website

Each time the website is accessed, our website records (i) the IP address, (ii) the start and end of the session for the duration of the session, (iii) the browser used and its version, (iv) the operating system via which a Access takes place, (v) any referrer page, (vi) your Internet provider and (vii) similar data/information that is necessary for the corresponding maintenance of the website (in particular those that are necessary to ward off hacker attacks).
In such a case, the storage of the data is technically required and therefore also in compliance with data protection (legitimate interest). This data will not be processed further by us unless otherwise specified below.
We also use your data to fix errors on our website, to increase user-friendliness and to improve the effectiveness of our services.

3.2.2. contact

If you contact us using the form provided for this purpose on our website, by e-mail, by telephone, by post or by other means of long-distance telecommunication, the data you provide will be stored with us for 12 months for the processing of your request and for any follow-up questions. This data will not be passed on without your consent.

3.2.3. Registration and Customer Profile

When registering and/or creating a customer profile, the purpose of processing your personal data is (i) the technical operation of our website, (ii) the administration of your profile, (iii) the processing of order processes (this includes in particular order and payment processing as well as any credit checks), (iv) for advertising products that might interest you and (v) ongoing information about current campaigns (e.g. via newsletter or e-mail). When ordering via our web shop, the processing of your user data is also necessary for the fulfillment of the contract or for the implementation of pre-contractual measures (e.g. for credit checks).

3.2.4. Newsletter

You will only receive advertising information (newsletters, e-mails, etc.) from us with your consent or on the basis of legal permission. As part of the newsletter registration, we use the so-called double opt-in procedure: After registration, you will first receive an e-mail to the e-mail address you provided. Only after confirmation of this e-mail (e.g. by clicking on a confirmation link) will your registration become effective. The registration is logged by us in order to be able to fulfill our obligation to provide evidence (in particular your email address and the time of registration).

If you no longer wish to receive our newsletter, you can unsubscribe at any time by clicking on the unsubscribe link in the newsletter or directly in your customer account.

3.2.5. Advertising, market and opinion research

Your personal data will only be used for product-specific surveys and marketing activities if you give your consent in advance or if the law allows it and you have not objected to it. Your data will be used for advertising, market and opinion research purposes in accordance with the statutory provisions.

4. Data Security

We use technical and organizational security measures to protect your data against unauthorized, illegal or accidental access, loss, processing, use and manipulation. Your data is protected by a secure server.

Our security measures are constantly being improved to protect your data. Regardless of our security precautions, illegal interference by third parties (through malware, hacking, fax interception, etc.) cannot be completely ruled out. For this reason, we assume no liability for the disclosure of information due to errors in data transmission not caused by us and/or unlawful access to data by third parties.

5. Disclosure of data to third parties and transfer of data abroad

Your personal data will only be passed on to third parties in accordance with data protection regulations, namely if you have consented to the forwarding of your data or if this is necessary to process the contract or to fulfill legal obligations. It may also be necessary to pass on your data to prevent misuse (e.g. credit card misuse). The service providers we use only receive your personal data in order to be able to process the contracts concluded with you. Our service providers may only use your data to fulfill their task. We also ensure that our service providers comply with data protection regulations.

The level of data protection in third countries may not correspond to that in Austria. For this reason, your data will only be transferred to third countries if the EU Commission has decided that this country has an adequate level of data protection or other suitable data protection guarantees (such as standard contractual clauses concluded by us) are in place.

If our company is transferred in whole or in part to third parties, your data will also be transferred. However, the validity of the data protection declaration remains unaffected by such processes.

6. Deletion of personal data

We will not keep your personal data longer than is necessary to fulfill our contractual or legal obligations, to defend against any liability claims and to end any legal disputes in which the data is required as evidence. When the contract is concluded, your data will be stored until the tax retention period of seven years has expired. Name, address, ordered goods and date of purchase will also be stored for a period of 10 years after the product has been placed on the market in order to be able to meet any claims under the Product Liability Act.
If you register with us on the website and/or create a customer profile and you have provided personal data, we generally store this for a period of 3 years after your last contact with us, unless you revoke your consent beforehand .

7. Notification of Data Leaks

We always try to detect data leaks early. We will report any data breaches (data breach) to you and/or the responsible supervisory authority, stating the data concerned (data breach notification).

After receipt of your application, we must respond to it within one month or respond to your application.

If you believe that the processing of your data violates data protection law or your data protection rights have otherwise been violated in any way, you can also complain to the responsible supervisory authority; in Austria this is the data protection authority, Barichgasse 40-42, 1030 Vienna.

9. Right to Object

You can object to the processing of your data for direct marketing purposes at any time.

You also have the right to object to any further processing of your personal data. In such a case, we will no longer process your data unless there are compelling reasons for processing that are worthy of protection.

You can exercise your right of objection on our homepage at https://www.thewedplanologist.at or by telephone +43 664 7517 1661 or by writing to The WedPlanologist eU, Seilerstätte 10/I/2/7, 1010 Vienna.
